These Terms of Service ("Terms") govern your use of Smart Breadcrumbs (the "App"), a Shopify app published by Tiwaa ("we", "us", "our"). By installing or using the App, you agree to these Terms. If you do not agree, uninstall the App.
1. Use of the App
You may use the App solely to add breadcrumb navigation to your Shopify storefront for your legitimate business purposes. You must:
- Comply with Shopify's Terms of Service and Partner Program Agreement.
- Not attempt to reverse-engineer, decompile, or extract the App's source code.
- Not use the App in a manner that could damage, disable, or impair our services or Shopify's infrastructure.
- Not resell or sublicense access to the App.
2. Account & Billing
The App offers a 7-day free trial with full feature access. After the trial, a paid subscription (Basic or Pro) is required to continue using the App. All billing is handled by Shopify through the Shopify Billing API — we never process payment card data directly.
Subscriptions are charged monthly in advance. You may cancel at any time from your Shopify admin; access continues until the end of the paid billing period. No refunds are issued for partial billing periods.
3. Intellectual Property
The App and all related content, design, and code are the exclusive property of Tiwaa and are protected by copyright and other intellectual property laws. These Terms do not grant you any ownership interest in the App.
You retain ownership of your store's content and data. By using the App, you grant Tiwaa a limited, non-exclusive licence to access your store data solely to provide the App's functionality.
4. Availability & Support
We aim for high availability but do not guarantee uninterrupted service. Planned maintenance will be communicated where possible. Support is available via email at support@tiwaa.io; we target a response within 1 business day.
5. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be error-free or that defects will be corrected.
6. Limitation of Liability
To the maximum extent permitted by law, Tiwaa's total liability to you for any claims arising from your use of the App shall not exceed the amounts you paid to us in the 3 months preceding the claim. In no event shall we be liable for indirect, incidental, special, consequential, or punitive damages.
7. Termination
We may suspend or terminate your access to the App at any time if you materially breach these Terms or if we discontinue the App. On termination, your shop data will be deleted in accordance with our Privacy Policy.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Disputes shall be submitted to the exclusive jurisdiction of the courts of India.
9. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via the App or email. Continued use of the App after the effective date of a change constitutes acceptance.
